Sole Source Affidavit

Before me, the undersigned authority, on this day personally appeared Phillip H. Steinert, who, being by me duly sworn, upon oath deposes and says:

1. I am over the age of eighteen (18) years, of sound mind, and fully competent to make this affidavit. I have personal knowledge of the facts stated herein, and they are true and correct.
2. I am the Managing Member of TXCCMRI, LLC, a Texas limited liability company located in Austin, Texas.
3. TXCCMRI, LLC is the sole developer, owner, operator, and distributor of the educational analytics software platform known as CCMRI (College, Career, and Military Readiness Intelligence) (the “Platform”). The proprietary algorithms, source code, designs, copyrights, and trademarks of the Platform are owned directly by TXCCMRI, LLC.
4. The Platform is available from only one source, TXCCMRI, LLC, within the meaning of Texas Education Code § 44.031(j)(1), by reason of the following patent, copyright, and trademark protections and secret processes:
   • Patent pending. U.S. Provisional Patent Application No. 64/068,075, titled “System and Method for Adaptive Student Readiness Scoring, Gamified Case Management, and Integrated Specialized Program Compliance in K-12 Educational Settings,” filed May 17, 2026. The application covers the Platform’s core gap-scoring, balanced-roster caseload constraints, and 2031 differential model switcher.
   • Copyright. U.S. Copyright Office Service Request No. 1-15165308061, titled “CCMRI — College, Career & Military Readiness Intelligence Software Application Source Code,” filed May 17, 2026. The work is the Platform’s proprietary source code, database architecture, and data normalizer adapters.
   • Trademark. U.S. Trademark Serial No. 99828689 for the mark CCMRI (Class 042, software as a service for educational analytics and tracking), filed May 17, 2026.
5. The Platform incorporates proprietary features and processes developed by TXCCMRI, LLC, including: (i) adaptive multi-pathway gap scoring, which normalizes assessment scales across SAT, ACT, and TSIA2 and groups students into five readiness tiers for targeted counselor case management; (ii) a caseload drafting interface that enforces a balanced-roster constraint across all five tiers; (iii) a dual accountability model switcher that recalculates district, campus, and student scores, projections, and tiers between the current TEA accountability system and the 2031 differential weighting framework under House Bill 8; (iv) an integrated P-TECH and outcomes-based management suite; and (v) a hybrid PostgreSQL gateway option that keeps district roster and evidence data in district-managed PostgreSQL.
6. TXCCMRI, LLC is the sole source and direct distributor of the Platform in the State of Texas. No other person is authorized to license, resell, or broker the Platform.
7. To the best of my knowledge, no other product or service in the K-12 educational market offers the same combination of features as the Platform.
