Proprietary Educational Software Exemption

Before me, the undersigned authority, on this day personally appeared Phillip H. Steinert, who, being by me duly sworn, upon oath deposes and says:
- I am over the age of eighteen (18) years, of sound mind, and fully competent to make this affidavit. I have personal knowledge of the facts stated herein, and they are all true and correct.
- I am the Founder and Manager of TXCCMRI, LLC, a Texas limited liability company with principal business offices located at 25626 Willard Path, San Antonio, TX 78261.
- TXCCMRI, LLC owns or holds all exclusive intellectual property, source code, designs, and proprietary algorithms associated with the educational analytics platform known as CCMRI™ (College, Career, and Military Readiness Intelligence), which has been assigned directly to the operating entity by its inventor and founder, Phillip H. Steinert. TXCCMRI, LLC holds the sole, exclusive right to operate, support, distribute, and license the CCMRI™ software platform to public, private, and charter K-12 educational agencies in the State of Texas.
- I solemnly swear and affirm that the CCMRI™ software application is a **sole source product**, and competition is precluded under **Texas Education Code § 44.031(j)(1)** due to the existence of the following patent, copyright, and trademark protections:
- Utility Patent Protection (Patent Pending): U.S. Utility Provisional Patent Application No. 64/068,075, titled "System and Method for Adaptive Student Readiness Scoring, Gamified Case Management, and Integrated Specialized Program Compliance in K-12 Educational Settings," filed May 17, 2026. This patent application covers the core gap-scoring, balanced roster snake-draft caseload constraints, 2031 differential model switcher, and non-profit direct teacher educational grant ledgers.
- U.S. Copyright Protection: U.S. Copyright Registration Service Request No. 1-15165308061, titled "CCMRI — College, Career & Military Readiness Intelligence Software Application Source Code," filed May 17, 2026. This copyright protects the proprietary source code, database architectures, and data normalizer adapters.
- U.S. Trademark Protection: U.S. Trademark Serial No. 99828689 for the mark "CCMRI" (Class 042 - SaaS for educational analytics and tracking), filed May 17, 2026.
- I further swear and affirm that the CCMRI™ software platform incorporates proprietary features and "secret processes" that are not available in any other educational tracking or student information software. These unique systems include:
- Adaptive Multi-Pathway Gap Scoring: An algorithm that normalizes assessment scales across SAT, ACT, and TSIA2, and groups students into five actionable readiness tiers (Layup, Contender, Project, Diamond in Rough, and Hail Mary) for targeted counselor case management.
- Gamified Caseload Snake Draft: An interactive caseload-drafting interface that enforces a strict "Balanced Roster Constraint" requiring educators to draft students across all five difficulty tiers to prevent cherry-picking.
- Dual Accountability Model Switcher: A real-time toggle that recalculates all district, campus, and student scores, projections, and tiers between the current equal-weight TEA system and the upcoming 2031 Differential Weighting Framework (HB 8).
- Educational Grant Allocation Ledger: A leaderboard and automated grant tracking engine that calculates teacher performance metrics and manages direct 501(c)(3) Educational Grant routing to top-performing educators.
- Integrated P-TECH & OBM Suite: A performance-blind application portal, weighted random demographic lottery, and cohort access/attainment/achievement compliance dashboard.
- Data Sovereignty SQL Gateway (BYODB): A zero-cloud architecture option allowing district student data to reside entirely on local SQL databases while interfacing securely via a containerized REST gateway.
- TXCCMRI, LLC is the **sole source provider** and direct distributor of the CCMRI™ software platform in the State of Texas. There are no other authorized distributors, catalog resellers, or brokers of this software. No other product or service exists in the K-12 educational market that offers these combined features, making functional equivalence impossible.
